The Hon’ble three-Judge Bench constituted by Hon’ble Justices UU Lalit, Ajay Rastogi, and Aniruddha Bose was considering the petition filed by a group of male nurses challenging an order dated 23.09.2020 pronounced by the Hon’ble Patna High Court. Last year, the Petitioners who were aggrieved by an order given by the Central Administrative Tribunal upholding AIIMS decision approached the Hon’ble High Court.
The petitioners in their plea stated that the recruitment criterion at institutions like AIIMS must be based on efficiency, competency, and expertise in nursing and cannot be relied on a one-sided notion that women are more efficient in attending the patients than men.
The petitioners who are contractual employees of AIIMS, Patna further contended that despite having a degree /diploma in Nursing courses they will not be promoted to regular employees if the said provision is implemented. They pleaded that direct recruitment of 80 Percent females will affect their future advancements in employment.
While issuing the notice which is returnable by 6 September after hearing the petitioner’s arguments, the Hon’ble Court remarked there are divergent views on the issue.
