On Tuesday, The Calcutta High Court had expressed certain dissatisfaction with the conduct of the police authorities of Alipurduar Police Station when they did not register an FIR despite receipt of complaint with respect to the non-payment of compensation as under Land Acquisition Act, 1894.

The Court further highlighted that as was laid down by the Supreme Court in the judgement of Lalita Kumari v. Govt. Of U.P. & Ors, the police authorities were bound to register the FIR and start investigation upon the receipt of a complaint that disclosed a certain cognisable offence.
Furthermore, the senior counsel that had appeared for the former Additional Land Acquisition Collector had apprised the Court that the money that was to be paid to the writ petitioner had been transferred by mistake, to any relative of the third person who bears the same name as the writ petitioner. The Court was also then informed that after detection of this mistake, the money was eventually transferred back to the account of the writ petitioner and relevant records with respect to this was also submitted before the Court.
