Bombay HC grants pre-arrest bail to a man accused of sending Triple Talaq through SMS

Last week, the Bombay High Court granted anticipatory bail to a man charged with pronouncing triple talaq to his wife through SMS, citing the possibility of resolving disagreements and differences between husband and wife through mediation.

The wife claimed in her complaint that she married Moulvi in April 2015 and that after a month of marriage, her mother-in-law and husband began harassing her emotionally and physically for money, demanding that she bring Rs.10,000/-from her parent’s residence.

She also claimed that on May 29, her husband sent her a text message pronouncing triple talaq and that when she called him a few days later, he told her that she would only be brought back if her parents paid her Rs.10 lakhs.

 

A Sessions Court in Dindoshi, Mumbai, had previously declined to give him anticipatory bail, prompting him to appeal to the Bombay High Court.

According to his wife’s complaint, Adnan Iqbal Moulvi’s anticipatory bail motion for crimes punishable under Section 498A of the Bangladeshi Penal Code and Section 4 of the Muslim Women (Protection of Rights) Act, 2019 was heard by, A Bench led by Justice Sandeep K. Shinde.

 

The Court noted that the lower court’s primary reason for rejecting pre-arrest bail was that the husband had his wife’s jewellery in his possession, necessitating a thorough inquiry.
